Terms of Use
These Terms of Use ("Terms") govern your use of the PassDays mobile application ("PassDays" or "the App"). PassDays is developed and provided by Vladislav Golovachev, acting as an individual developer ("we", "us", or "the developer"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms work together with our Privacy Policy, which explains how your information is handled.
PassDays does not provide legal, tax, or immigration advice. Information provided by the App is for personal tracking purposes only and should not be relied upon for visa compliance, tax residency determination, or any legal decision. Day counts, limit calculations, and auto-detected locations may be incomplete or inaccurate, and the rules they are based on can change. Always verify with official sources and consult qualified professionals before making any decision that depends on your days of presence in a country.
1. Eligibility and age
PassDays is rated 4+ on the App Store and is suitable for users of all ages. These Terms, however, are a legal agreement: to accept them and to make any purchases, you must have the legal capacity to do so under the law of your country. If you are a minor, you may use the App only with the involvement of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for any purchases. By using the App you confirm that you meet these requirements.
2. What PassDays is
PassDays is a personal travel day-counting tool that runs on your device. It helps you record the days you spend in different countries, configure visa, residence, and other day-limit trackers, and view statistics about your travel. It can optionally auto-detect your current country from location, import trips from photo metadata or CSV files, export your history, and sync to your own iCloud.
PassDays is an informational and personal-organization tool only. It is not an official record, a government service, or a substitute for professional advice or official documentation.
3. No legal, tax, or immigration advice; no guarantee of accuracy
As stated at the top of these Terms, PassDays does not provide legal, tax, or immigration advice, and nothing in the App constitutes such advice. The App relies on information that you enter and on automated sources — manual entries, dates and coordinates read from photo metadata, GPS-based country auto-detection, and reverse-geocoding — all of which can be incomplete, delayed, or wrong. Visa, residence, and tax rules differ by country and change over time, and the App may not reflect the current rules that apply to you.
You are solely responsible for your own travel, visa, residence, and tax compliance decisions. To the fullest extent permitted by law, the developer is not responsible for any fine, penalty, denial of entry, deportation, overstay, loss of status, tax assessment, or other consequence arising from your reliance on information shown by the App. Always confirm your situation with official sources and qualified professionals.
4. License to use the App
Subject to these Terms, the developer grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the App for your own personal, non-commercial purposes on an Apple-branded device that you own or control, in accordance with the Usage Rules in the Apple Media Services Terms and Conditions. All rights not expressly granted are reserved.
5. Acceptable use
When using PassDays, you agree not to:
- copy, modify, distribute, sell, rent, lease, or sublicense the App or any part of it;
- reverse engineer, decompile, or disassemble the App, or attempt to derive its source code, except to the limited extent this restriction is prohibited by applicable law;
- circumvent, disable, or interfere with any purchase, subscription, security, or access-control mechanism of the App;
- use the App for any unlawful purpose or in violation of any applicable law or third-party rights;
- interfere with or disrupt the integrity or operation of the App or any connected services.
6. Subscriptions, purchases, and billing
PassDays is free to download and includes a free tier. Some features are available through an optional auto-renewing subscription (PassDays Premium, offered in monthly and yearly options). The current features, prices, and any free-trial terms are shown inside the App and on the App Store at the time of purchase.
- Payment is charged to your Apple ID account at confirmation of purchase.
- A subscription automatically renews for the same period unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel your subscription at any time in Settings → [your Apple ID] → Subscriptions on your device. Deleting the App does not cancel a subscription.
- If a free trial is offered and you purchase a subscription, any unused portion of the trial is forfeited at the time of purchase.
- Payments, billing, and refunds are handled by Apple in accordance with the Apple Media Services Terms and Conditions. The developer generally cannot issue refunds directly; refund requests are made through Apple.
- Prices and the set of features included in the free and premium tiers may change over time. Changes apply going forward and, for subscriptions, take effect on renewal.
7. Changes to the App and its features
The App is offered on an ongoing, evolving basis. We may add, change, suspend, limit, or discontinue any feature, the division between free and premium features, or the App as a whole, at any time, with or without notice. We may also test different versions, prices, and feature arrangements for different users. To the extent permitted by law, we are not liable to you for any modification, suspension, or discontinuation of the App or any feature.
8. Termination
You may stop using PassDays at any time and delete it from your device. We may suspend or terminate your access to the App or to any feature at our discretion, including if you breach these Terms or misuse the App. Provisions that by their nature should survive termination — including the disclaimers, limitation of liability, and the App Store terms below — will continue to apply after these Terms end.
9. Disclaimer of warranties
The App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or available at any particular time, or that any calculation, day count, limit, or auto-detected location it produces is accurate, complete, or current. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
10. Limitation of liability
To the fullest extent permitted by applicable law, the developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of, or inability to use, the App. In particular, and without limitation, the developer is not liable for any fine, penalty, denied entry, deportation, overstay, or visa, residence, or tax consequence resulting from reliance on the App.
To the fullest extent permitted by law, the developer's total liability for all claims relating to the App will not exceed the greater of (a) the amount you paid for the App or subscriptions during the twelve months before the event giving rise to the claim, or (b) the minimum amount required by applicable law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you.
11. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the developer from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any law or the rights of a third party.
12. Third-party services
PassDays relies on services provided by third parties, each governed by its own terms and privacy policies. These include Apple (the App Store, in-app purchases, iCloud / CloudKit, and location and geocoding services), Google Firebase (analytics and crash diagnostics), and Adapty (subscription management and processing). We are not responsible for the availability, performance, or policies of third-party services, and your use of them is at your own risk.
13. App Store terms (Apple)
The following terms apply because PassDays is distributed through Apple's App Store:
- These Terms are concluded between you and the developer only, and not with Apple. The developer, not Apple, is solely responsible for the App and its content.
- Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the developer's responsibility.
- The developer, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, claims arising under consumer protection or similar legislation, and intellectual property infringement claims.
- You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
14. Privacy
Your use of the App is also governed by our Privacy Policy, which describes what information the App handles and the controls you have. Please review it to understand our privacy practices.
15. Governing law
Except where prohibited by local law, these Terms are governed by the laws of the developer's country of residence, without regard to its conflict-of-laws rules. Regardless of the governing law, if you use the App as a consumer you continue to benefit from any mandatory consumer-protection rights granted to you by the law of the country in which you live, and nothing in these Terms overrides those rights.
16. Changes to these Terms
We may update these Terms from time to time. When we do, the "last updated" date at the top of this page will change. Material changes will be announced in a future App update. Your continued use of the App after changes take effect means you accept the updated Terms.
